The Local Plan Process

The Aberdeenshire Local Plan is the result of a process including several stages of public consultation. In 2002 Aberdeenshire Council published the Finalised Aberdeenshire Local Plan and a lengthy consultation period followed. As a result of the public consultation, objections were received and a set of modifications were proposed to the Plan. Not all issues raised by objections were satisfactorily resolved by these modifications.

In September 2004 a Public Inquiry commenced into unresolved objections to the policies and proposals contained within the Plan. As a result of the Public Inquiry, the Scottish Executive published a Report comprising summaries of the objections, the Council's responses, the Reporters' conclusions and finally their recommendations. Most of these recommendations were subsequently accepted by the Council prior to the adoption of the Aberdeenshire Local Plan. You can view the Report on Objections to the Finalised Aberdeenshire Local Plan by clicking on this link.

Current Stage

On the 22nd June 2006, the Council received a letter from the Scottish Executive confirming that Scottish Ministers did not propose to issue a Direction in the case of the Plan and that the Council could proceed to adopt the Plan. The Infrastructure & Services Committee agreed accordingly on the 22nd June 2006(confirmed by full Council on 29th June 2006) to adopt the Plan. On the 30th June 2006 the Cairngorms National Park Authority adopted the Plan. On the 30th June 2006 the adoption of the Plan was completed and the adopted Plan became operative from that date.

Notice of the adoption of the Plan was advertised on the 14th July 2006 and the period for any challenge to the plan in the Court of Session  was the six weeks from the 14th July 2006.

The plan now forms part of the statutory Development Plan for Aberdeenshire.
