Local Plan Inquiry

The Council received the Report from the Scottish Executive Inquiry Reporters on the 11th July 2005.

This Report considers all objections lodged, and not subsequently unconditionally withdrawn, against the terms of the Finalised Aberdeenshire Local Plan.

The Report is set out in seven volumes:

  1. Introduction and Policy Objections - Reporter = Both
  2. Banff & Buchan Area Objections - Reporter = Richard Dent
  3. Buchan Area Objections - Reporter = David Russell
  4. Formartine Area Objections - Reporter = Richard Dent
  5. Garioch Area Objections - Reporter = David Russell
  6. Kincardine & Mearns Area Objections - Reporter = Richard Dent
  7. Marr Area Objections - Reporter = Both

The inquiry took place on various dates between 31 August 2004 and 4 February 2005 in various locations in Aberdeen and Aberdeenshire. Where requested, the proceedings took the form of a public local inquiry but, for the most part, the objections were discussed at informal hearings. Certain policy objections were heard by the Reporters sitting jointly.

On two occasions, objectors requested interim rulings. These requests were put to the Council and the Reporters were instructed not to accede but to continue with the agreed inquiry programme. The objectors were informed accordingly.

In considering objections, account has been taken of the evidence presented at the inquiry, written material, supporting documents and site inspections. When requested, the Reporters visited objection sites on an accompanied basis. Documents published after the conclusion of the inquiry have not been taken into account.
 
Recommendations are made in respect of all objections heard at the inquiry and those where objectors elected to rest on written submissions. Objections deemed by the Council as invalid or not in conflict with the terms of the plan have not been considered and are not the subject of recommendations.
