Certificate of compliance: mobile food traders

A certificate of compliance shows that a mobile food unit meets food safety requirements. You may need this if you prepare or sell food from a mobile unit (such as a vehicle, kiosk or stall).

The certificate does not grant permission to trade. If you plan to trade in a public place in Aberdeenshire, you will also need to apply for a street trader’s licence.

When you don't need a certificate

You don't need to apply for a certificate of compliance if:

  • You already hold a valid certificate issued by another local authority in Scotland (only one certificate is required per vehicle)
  • You only trade at private events on private land (for example, weddings or private parties)
  • You only trade at events covered by a public entertainment licence (such as farmers’ markets)

Requirements and conditions

To be granted a certificate of compliance, your mobile premises must meet the mobile traders food hygiene national standards (PDF 408KB).

You must also register as a food business with the council.

If you use gas equipment, you may also need to have a valid gas safety check.

Application fee

The fee for a certificate of compliance is £120.

The fee must be paid at the time of application. Applications will not be processed until payment is received. The fee is non-refundable.

Alternatively you can apply in paper by completing the certificate of compliance form (PDF 329KB) and sending it to environmental@aberdeenshire.gov.uk.

What happens next

Once we receive your completed application and payment, we aim to respond within 10 working days.

Changes to your circumstances

A certificate of compliance is not transferable.

You must apply for a new certificate if:

  • You replace your current vehicle or unit
  • You add additional vehicles or units (each unit requires its own certificate)
  • You sell or transfer ownership of the unit (the new owner must apply for their own certificate)

You should inform us of any changes to your circumstances as soon as possible.

Duration of the certificate

If granted, your certificate of compliance will take effect on the date shown on the certificate, and is valid for 3 years from that date.
